It is heartbreaking to see a “doctor” advocating for FGM in 2019. There is something very wrong in our constitution/laws if such a case can be allowed to be filed in court. In 2019!

What will prevent some other wacko from a cult that demands male castration, from demanding doctors be allowed to castrate men if they ask for the procedure?

It is our bodies, and we can do whatever we want with our bodies, right?

Another cult might demand that their followers be allowed to cut the right hand…

Nairobi resident sues Health ministry, seeks total ban on tobacco in Kenya.

In a suit filed at the High Court, one Ibrahim Mohamud Ibrahim has faulted the government for allowing production, manufacturing, distribution, management, dissemination and consumption of tobacco in the country regardless of its effects on health…

He further wants it declared that cancer is a tobacco related ailment and a national disaster requiring special administrative action which includes banning cigarettes.”

Cigarettes are bad, but this is not the way to deal with the problem. If this kind of court cases are allowed to go on, what will prevent a person who gets a Light bulb moment telling him Kenya should start driving on the right, from filing a suit in the High Court demanding that?

It has reached a point in Kenya whereby someone wakes up and feels he needs to appear on the evening news. He goes ahead and files a preposterous case in court. This is wasting the court’s time and resources.

If someone wants to file these type of cases, go right ahead, but should pay a substantial non-refundable fee to the court first. I would recommend sh5 Million non-refundable fee to file these “public interest” suits in court.

If someone has a genuine “public interest” case he wants to file in court, he should be able to get 100,000 Kenyans each contributing sh50 to file the case (or whatever method he wants to use to raise the fee). This will reduce these types of suits, and also, the courts get much needed funding in the process.

There are so many of these types of cases filed of late, clogging the court system. Someone seeking vengeance because of a missed tender or big job, pays an underling to file a suit in court alleging that the company/organisation has breached the constitution due to A, B, or C.

The court system is being abused. This is not right, especially considering that the country does not have enough judges and magistrates.

A man has gone to court to fight for prisoners’ right to vote in all elective posts in a general election.

“Mr Wilson Kinyua has sued the Independent Electoral and Boundaries Commission (IEBC), the Kenya Prisons Service and the Attorney-General, seeking to have prisoners allowed to vote for all elected leaders.

“Currently, prisoners can only vote in the presidential election…

“In 2013, a similar suit was taken before the corridors of justice by Kituo Cha Sheria where the court directed the IEBC to put in place measures to ensure that prisoners are registered to vote in general elections.

“High Court Judge David Majanja declared that prisoners are entitled to be registered as voters and have the right to vote under the Constitution.

“The IEBC complied but limited voting for prisoners to the presidential vote only.”
