According to President Uhuru Kenyatta, "the country almost lost Sh7 billion in the Mwea irrigation scheme project after the courts issued injunctions against it. The project, which was due to be sponsored by the Japanese government, dragged on for more than 10 years."

Judiciary is sabotaging the war on corruption. The executive should liaise with parliament to come up with a new Anti-Corruption Court independent of the current judiciary; the Anti-Corruption Court judges should be appointed by the president & vetted by parliament.

Although many MPs are also corrupt, they wouldn’t want to be seen by their constituents as opposing plans to slay the corruption dragon, and would most likely support such plans, even if reluctantly.

All Kenyans who are not eating - and these are the majority - are very angry at the wanton eating at both national and county governments. The best gift the president can give Kenyans is to do what needs to be done to bring corruption to an end.

To reduce opposition to the establishment of such an anticorruption court, it should be stated that the special independent court will only target the bigshots - corruption cases where the amount of money alleged to have been stolen or misappropriated is more than KSh 100 million.

To ensure Kenyan white-collar thieves realize things are hot, if such a court is ever realized, the following laws should be enacted(for that court only):

1. To protect Kenyan taxpayers - Bond must be set at a minimum of 100 times the alleged looted money.

2. To protect the rights of the accused - If case is not concluded within 2 years, suspect must be released and only be re-arrested if they fail to appear in court at the appointed time. And, if they are eventually found innocent, they will be entitled to KSh X compensation, as set by parliament.

During the fight for multiparty politics in Kenya, the Law Society of Kenya(LSK) was very vocal. Most Kenyans wanted the country to become a multiparty democracy. So were most lawyers, as was the LSK.

However, there were KANU-allied lawyers who wanted Kenya to remain a single party state. Despite the heated atmosphere and differences of opinion, LSK did not breakup.

But in the year 2019, LSK is breaking up, and a splinter group has already applied for registration - All because of fallout over who to represent LSK in the JSC.

If Kenyans wanted any confirmation about the rot in the country’s judicial system, this is a perfect example.

SOLUTION: If the constitution is to be amended, I wish the following changes were made to the judiciary:

1. All members of JSC be appointed by the president, and vetted and voted for by parliament.
2. All Supreme Court justices be appointed by the president and vetted and voted for by parliament.

As long as MPs and President are elected directly by the people, then they are the peoples’ representatives. If they are bad, then the people are bad, and vice versa.

Kenya has tried to have an “independent Judiciary”, but what the country has ended up with is a judiciary hijacked by busybodies, NGOs, and people who hate Kenya.

If these people/groups feel they are so important that they should be able to play some role in the country’s judicial system, let them become candidates for MPs & Presidency, and let Kenyans decide. That is what democracy is all about.
