Keroche Breweries Owners to be Charged Over 14.4 Billion Tax Evasion

“The Director of Public Prosecutions Noordin Haji has ordered the arrest and arraignment of the directors of Keroche Breweries Ltd over tax evasion. Keroche Chief Executive Tabitha Karanja and her husband Joseph Karanja, who is the chairman of the company, are accused of evading payment of tax totalling to Sh14.4 billion.”

If I was the lawyer for Mrs Karanja or Humphrey Kariuki, I would advise them not to try to escalate matters, and to consider themselves lucky that they have not been charged with endangering the lives of Kenyans by selling them UN-INSPECTED bootleg.

What kind of alcohol renders a 21 year-old man impotent? What are the ingredients? Could there be a hidden agenda?

The situation is so bad in certain parts of Kenya that the popular musician John DeMathew sang about it, in the song
nengereria kane, where he condemns bootleg that is “castrating young men”.

Kenyans would be shocked if they learnt that the so-called alcoholic beverage “industrialists” do not even know the chemical formula of ethanol. There is a reason why none of these so-called “industrialists” have never ventured into industries like making bread, maize flour, or even the potentially lucrative coffee & tea blending (for export) etc.

For years, if you were corrupt, greedy and creative enough, you could simply buy ethanol tax-free (through corruption), mix it with water and soft drinks or fruit juices from any supermarket, and voila! you had your own unique alcoholic drink.

All that remained was to give these drinks a macho-sounding name, and you were in business. You were now officially a Kenyan “industrialist”.

This is the reason why at the peak of the “alternative alcohol” epidemic in (Central) Kenya, there were dozens (if not hundreds) of companies making these alcoholic drinks.

These “wines”, “vodkas” etc. would be cheap because the companies didn’t pay taxes (bribed corrupt KRA officials instead). They would be unfit for human consumption (since they did not pass KBS inspection - bribed corrupt KBS officials).

Once you made good money, you would now start employing learned people, to make more palatable & hygienic drinks. If you were ambitious, you would get licences from abroad to make respectable alcoholic drinks.

But there was a huge problem, always. Since what you are making is neither better, nor of higher quality than what is already on the market (this needs major investment/research/time, and you are a shortcut person), the only way you could break even is to continue cutting corners - by stiffing the taxman.

Finally, you are found out. You know you have no chance of winning in court against the taxman. You go to the press. And pay some bloggers & KOT to shout that Kenyan “industrialists” are being targeted by the “dynasties”.

Keroche Breweries : “In a public statement yesterday, the brewer which is in court for alleged tax evasion poked holes in the case being fronted by the Director of Public Prosecution (DPP), where the company is alleged to owe Kenya Revenue Authority (KRA) Sh14.4 billion…

Keroche CEO Tabitha Karanja: “The presentation of an inaccurate file of accusation to the DPP, the deliberate publishing of false information to defame and destroy the reputation of a local Kenyan company reeks of malice, sabotage and not due process.”

Mrs Karanja’s lawyer is Siaya Senator James Orengo, one of the top lawyers in Kenya. Mr Orengo is:

1. A Senior Counsel

2. The Senate Minority leader

3. A Member, Senate Committee on Justice, Legal Affairs & Human rights (has oversight role over the DPP)

Therefore, the fact that Mrs Karanja is fighting the tax evasion charges in the press, rather than in court, can only mean ONE thing - Her counsel has told her: “I have seen the evidence against you and your company, and things do not look good. We have ZERO chance of winning this case in court.”

If it were not for the handshake between President Uhuru Kenyatta and former Prime Minister Raila Odinga, the DPP, DCI chief and KRA chief would now be facing impeachment motions in parliament, “for maliciously prosecuting indigenous “industrialists””.

There would be political meetings across the country, attended by dozens of MPs and senators, condemning “selective prosecutions” aimed at “destroying companies whose owners are perceived to support the opposition”.

This is why it was impossible to successfully fight corruption in the past.
